Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the website located at njpremiumbuilders.com (the "Site") and any services, estimates, or construction work provided by NJ Premium Builders, with its principal place of business at 26 Wilson St, Garfield, NJ 07026 ("Company," "we," "us," or "our"). By accessing the Site, requesting a quote, or engaging us for services, you ("you" or "Client") agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under the laws of the United States and the State of New Jersey to use the Site or engage our services.
3. Services
NJ Premium Builders provides deck construction, deck repair and restoration, composite and wood decking installation, masonry, paver installation, and chimney services within Bergen County, New Jersey and surrounding areas. All services are subject to a separate written contract or work order signed by both parties, which will control in the event of any conflict with these Terms.
4. Estimates, Quotes & Pricing
Quotes provided through the Site, by phone, by email, or in person are non-binding estimates based on the information provided by the Client and a visual inspection of the project site. Final pricing is subject to a signed written agreement. Estimates are valid for thirty (30) days unless stated otherwise. Changes in scope, materials, site conditions, or applicable code requirements may result in change orders and additional charges.
5. Permits, Codes & Property Access
The Client is responsible for ensuring legal access to the property and for disclosing all easements, restrictive covenants, HOA rules, and known underground utilities. Required building permits and inspections will be obtained as specified in the project contract. All work will be performed in substantial compliance with applicable New Jersey state and Bergen County municipal building codes.
6. Payment Terms
Payment terms, deposit amounts, and payment milestones are set forth in the project contract. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by New Jersey law (N.J.S.A. 31:1-1). The Client agrees to pay reasonable collection costs and attorneys' fees incurred to collect any past-due amount.
7. Warranties & Disclaimers
Workmanship is warranted as expressly set forth in the signed project contract. Manufacturer warranties for materials (such as composite decking, stains, hardware, and pavers) are passed through to the Client and governed by the respective manufacturers' terms.
EXCEPT FOR THE EXPRESS WARRANTIES IN THE PROJECT CONTRACT, THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, NJ PREMIUM BUILDERS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION. THIS DISCLAIMER DOES NOT LIMIT ANY NON-WAIVABLE CONSUMER RIGHTS UNDER THE NEW JERSEY CONSUMER FRAUD ACT (N.J.S.A. 56:8-1 et seq.) OR THE NEW JERSEY HOME IMPROVEMENT PRACTICES REGULATIONS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NJ PREMIUM BUILDERS, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY FOR CONSTRUCTION SERVICES IS GOVERNED BY THE PROJECT CONTRACT. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT.
9. Indemnification
You agree to defend, indemnify, and hold harmless NJ Premium Builders and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.
10. Intellectual Property
All content on the Site, including text, graphics, logos, photographs of completed projects, and design elements, is the property of NJ Premium Builders or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without prior written consent.
11. Communications & Consent
By submitting your phone number or email address through the Site (including via the quote form), you consent to receive communications from us at the contact information you provided regarding your inquiry or project. Standard message and data rates may apply. You may opt out of marketing communications at any time by replying "STOP" or contacting us at the address below.
12. Third-Party Links
The Site may contain links to third-party websites (such as Google Maps, social media platforms, and review sites). We are not responsible for the content, policies, or practices of any third-party site.
13. Governing Law & Venue
These Terms and any dispute arising out of or related to the Site or our services are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. The exclusive venue for any dispute shall be the state or federal courts located in Bergen County, New Jersey, and you consent to the personal jurisdiction of those courts.
14. Dispute Resolution
Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at newjerseypremiumbuild@gmail.com. If we cannot resolve the dispute within thirty (30) days, either party may pursue formal proceedings in accordance with Section 13.
15. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" at the top of this page will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
